How to Incorporate a Company in Argentina as a Foreigner

Step-by-step guide to forming a company in Argentina — from selecting the structure to registering with ARCA.

May 12, 2026

The Requirements

To form a company in Argentina, you need a minimum of 2 partners (Argentine residents or non-residents), a registered legal address in Argentina, a legal representative with Argentine domicile, capital contribution (modest for an SRL), and a draft estatuto (company charter) prepared by an Argentine lawyer. Foreign nationals do not need residency to be partners in an Argentine company, but the legal representative must be domiciled in Argentina.

The Registration Process

Company registration involves: drafting and notarizing the estatuto, opening a bank account for the initial capital deposit, registering with the Inspección General de Justicia (IGJ) — the commercial registry — and then registering with ARCA (formerly AFIP) for a CUIT. The full process typically takes 4–8 weeks in Buenos Aires through the standard track.

The Roffo Advantage

Roffo handles the entire company formation process — from structure advice to estatuto drafting, IGJ registration, ARCA enrollment, and bank account opening. We also provide the legal representative service for clients who are not yet Argentine residents. Once formed, we can manage ongoing compliance, accounting and tax filing obligations.
